律师解读1128监管政策：重点规制利用稳定币非法换汇的行为

比推消息，11 月 28 日，中国人民银行联合十多个部门召开打击虚拟货币交易炒作工作协调会议（以下简称 1128 会议），强调了要继续坚持 2021 年《关于进一步防范和处置虚拟货币交易炒作风险的通知》（以下简称 9.24 通知）的相关规定，在我国大陆对虚拟货币的经营性业务采取禁止性政策，并且着重提出了要打击利用虚拟货币洗钱、非法资金出境的行为。
针对这一政策，肖飒律师解读表示，总体而言，1128 会议属于老调重弹，而此次要真正规制的，其实是利用稳定币非法换汇的行为，这一类行为严重破坏金融秩序。众所周知，我国规定了较为严格的外汇管制制度，一般情况下每人每年可兑外汇额度不超过 5 万美元。如今稳定币市场逐渐扩大、应用场景不断扩张、币商数量大增后，很多资金出境需求已经被 USDT 和 USDC 等稳定币解决。更有甚者，能够利用稳定币为上游犯罪提供便利的洗钱或掩饰隐瞒犯罪所得服务，更进一步，在司法实践中还曾经见过大胆的外贸商家，利用 USDT 和 USDC 来突破联合国制裁决议，协助被制裁国家对外贸易的情形。
从司法实践来说，近一两年来，我国司法机关对币商的规制力度逐渐提升，大量币商被以非法经营罪、帮信罪、洗钱罪和掩饰隐瞒犯罪所得罪定罪处罚。
此外，肖飒律师认为 1128 会议不会影响到我国香港对虚拟资产的开放政策。香港与大陆在对待虚拟资产这件事上，已经逐渐形成了一开放一限制的基本格局，监管的态度很明确：不是不给你金融创新，但你必须在我指定的地方创新。
